Linde To Pay $11.2 Million Gets FCPA Declination

Linde North America will pay $11.2 million and the Justice Department will close its investigation into alleged Linde violations of the Foreign Corrupt Practices Act (FCPA).

The company was represented by Lucinda Low and Thomas Best of Steptoe & Johnson in Washington, D.C.

A Justice Department investigation found that a Linde unit, Spectra Gases, made corrupt payments to high level officials in the Republic of Georgia.

The Department said that as a result of the corrupt conduct, Spectra Gases made $6.4 million while Linde made $1.4 million.

In a letter to Low and Best, the Department said it decided to decline prosecution of Linde for a number of reasons, including that the company disclosed the matter to the Department, that the company conducted a “thorough, comprehensive and proactive investigation,” and that the company terminated or took disciplinary action against employees involved in the misconduct.

As part of the agreement, the company will disgorge and forfeit a total of $11.2 million.
